West Virginia Public Service Commission: Good? Could Be Better?
Because it deals with such controversial issues as utility rates and siting of facilities, the Public Service Commission of West Virginia excites strong opinions.The State Journal asked observers of the commission for their views on some of the big electricity cases of recent years.
Not surprisingly, lawyers who represent applicants and who are in some instances colleagues with commissioners — at least one commissioner must be a lawyer, and two of the current three are — speak cautiously and favorably. Some declined to discuss the commission with the media. Citizens, on the other hand, who have felt compelled to intervene at their own expense in cases that mattered to them sometimes have strong criticisms. All are keen observers of the commission and their thoughts represent the range of truths about its workings.
Electric Rates
For the past few years, electric rates have spiraled up. The cases that decide those rates generate some of the most intense adversarial action at the PSC.
The recent revolving door of rate cases started with and is dominated by AEP’s filing in 2009 for a 43 percent increase based on a spike in coal prices.
That filing brought a massive outcry, and the commission handled it well, according to Spilman Thomas & Battle lawyer Derrick Williamson, who represents the West Virginia Energy Users Group of large industrial and manufacturing electricity users.
“The law says the utility is entitled to recover its reasonable and prudently incurred costs,” Williamson explained.
“The commission essentially allowed a level of those costs to be recovered, but provided for recovery to be phased in over a four-year period or longer,” he said. “That was intended entirely to mitigate the effects of such a large increase on customers by spreading it out over time, and it was relatively novel.“
Chris Callas at Jackson Kelly called the ruling “innovative.” Callas represents electric, gas and water utilities before the commission, as well as energy developers on siting and transmission cases.
“The big AEP rate case was a tough decision, and they found a way to manage it,” Callas said.

Hotrod, you make an interesting point. Look at the fence at lower falls, not much different from that of Vernal. Indeed, about 20-30 feet from the river, the fence ends. When there last year, I remember going back up with my son (no fence to our left), when a woman fell coming down--she was on my left, close to the river. That aside, I do not believe there are many people attempting to get into the river--unlike Vernal. If I figure out how to post photos, have a shot of lower falls brink/river with no fence.
