DA: Lebanon man convicted in robbery was innocent
Lebanon County District Attorney David Arnold said his office is petitioning the court to withdraw all charges against a 19-year-old city man convicted in a knife point robbery and assault.
Joshua Pond was found guilty by a jury in February, but Arnold said the accuser has since admitted to police that he falsely identified Pond has his attacker.
He said the accuser, Robert Giovanetti, will be charged with making a false report.
Arnold said the case represents the "best and worst scenarios of the criminal justice system."
"It is unacceptable when a witness to a crime intentionally identifies an innocent person as having committed a crime," he said. "At the same time, it is important to see that in Lebanon County, our police department and the District Attorney's Office seek truth and justice even after conviction."
While prosecutors petition to have the charges against Pond withdrawn, he remains in prison for an unrelated conviction.
