OPINION: Easton could benefit from vacant-property ordinance

The city of Easton’s renewed attack on blighted properties isn’t new at all. Decaying buildings have been a problem since the first colonist put off fixing the roof.

But the city has a thick file of buildings that are teetering off the “deferred maintenance” list and onto the “too serious to ignore” list. The planning department says 360 of Easton’s 8,500 properties could be considered blighted. More importantly, they’re suffering from neglect with little hope of rehabilitation anytime soon.

So if Mayor Sal Panto Jr., Councilman Roger Ruggles and other council members want to up the ante for people who are mothballing decrepit properties, they have thousands of allies in Easton — all those people who maintain their properties, care about their neighborhoods and want to see blocks freed of the dead anchors weighing them down.

The city is targeting 28 properties, some with high profiles — the old armory at Seventh and Northampton streets and the Rock Church’s Hooper House property at Fifth and Northampton streets. While these battles are worth fighting because of strategic location and historic value, the city has a greater mandate to help crowded residential areas, where one rat-infested vacancy can make life miserable for everyone else on the block.

The city’s existing tools are limited: If code enforcement doesn’t work, the Redevelopment Authority can seek a blight designation, condemn a property, buy it, rehab it, sell it. This helps the goal of increasing owner-occupied family dwellings, but the process is cumbersome and expensive. State funding for such programs is being scaled back.

Ruggles is proposing a vacant property registry, which would require owners to register empty buildings and pay an annual fee based on how long they have been unused. A law in Wilmington, Del., levies a $500 fee for properties vacant for one to two years and up to $5,000 for those vacant for 10 years.

Such a law must be applied uniformly to be fair — yet to be fair, it must allow exceptions for those being renovated or marketed. Some properties are better off being vacant but tended, especially if they take time to sell or rent.

The key is “blight.”

A vacancy registry law works best as an incentive for reluctant owners to sell if they can’t or won’t fix a property. Panto’s faceoff this week with Kevin Santos, attorney for the Rock Church, is a good example. The church has filed a plan to fix the property at Fifth and Northampton for several years, yet hasn’t made much progress. Santos told the city’s Historic District Commission the work depends on donations from parishioners. Panto said if the church can’t follow through, it should seek a buyer. Good point.
